1. These terms
These terms govern your use of BookProof, operated by OMNIAMUS S.R.L., Ploiești, Romania ("BookProof", "we", "us"). By creating an account or booking through a BookProof booking page you accept them. If you do not agree, do not use the service.
2. What BookProof is — and is not
BookProof is booking software we license to businesses. We are not a party to the appointment between a business and its client, we do not provide the services being booked, and we do not vet, endorse or supervise the businesses that use BookProof. Each business is solely responsible for the services it offers, the prices and deposits it sets, its cancellation terms, its tax obligations, and for actually honouring the appointments it accepts.
3. Provider accounts
- You must be at least 18 and able to enter contracts on behalf of your business.
- You are responsible for the accuracy of your business details and for everything done through your account.
- Keep your password confidential and tell us promptly if you suspect unauthorised access.
- One account represents one business. Do not create multiple accounts to obtain additional trials.
4. Subscription, trial and billing
BookProof is sold as a subscription at the prices shown in the app, currently EUR 19 per month or EUR 190 per year. New businesses may start a 14-day free trial; a valid payment method is required to begin it, nothing is charged during the trial, and cancelling before it ends costs you nothing. The trial is available once per business. When the trial ends the subscription starts automatically at the plan you chose unless you cancel first.
Subscriptions renew automatically until cancelled. You can cancel any time from the billing portal in the app; cancellation takes effect at the end of the paid period and you keep access until then. Except where the law requires otherwise, payments already made are not refundable for periods already served. If a payment fails we may retry it and, after a grace period, suspend your booking page.
5. Deposits
Deposits are paid by clients to the business, not to BookProof. They are processed through Stripe and settled to the business's own connected Stripe account, which makes that business the merchant for the payment and responsible for it, including for disputes and chargebacks. BookProof takes no commission from deposits.
Each business sets its own deposit amounts and free-cancellation window. Within that window a client who cancels is refunded automatically; outside it the deposit is not refunded. If the business cancels, the deposit is always refunded. Businesses are responsible for ensuring their deposit and cancellation terms comply with the consumer law that applies to them.
6. If you are booking an appointment
When you book through a BookProof page, your contract is with the business, not with us. The cancellation terms shown before you pay are that business's terms, and paying a deposit means accepting them. Questions about the service, the appointment or a refund outside the automatic rules should go to the business directly.
7. Acceptable use
- Do not use BookProof for anything unlawful, or to sell services you are not permitted to sell.
- Do not take deposits for appointments you do not intend to honour.
- Do not upload content that infringes others' rights or misrepresents your business.
- Do not attempt to breach, overload, scrape or reverse-engineer the service.
- Do not use BookProof to send unsolicited marketing to clients.
8. Availability
We work to keep BookProof available and reliable, but we provide it on an "as is" and "as available" basis. We may change, suspend or discontinue features, and we perform maintenance that can cause brief interruptions. We do not warrant that the service will be uninterrupted or error-free.
9. Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, for lost profits or lost bookings, or for the acts and omissions of businesses or their clients. Our total liability for any claim relating to the service is limited to the subscription fees you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence or for fraud.
10. Suspension and termination
You may stop using BookProof and delete your account at any time from Settings in the app; doing so permanently erases your business data and booking history. We may suspend or terminate an account that breaches these terms, that is used fraudulently, or where required by law. If we terminate without cause we will refund the unused portion of a prepaid period.
11. Changes to these terms
We may update these terms as BookProof evolves. We will publish the current version here and, for material changes affecting subscribers, give reasonable advance notice. Continuing to use the service after a change takes effect means accepting the updated terms.
12. Governing law and contact
These terms are governed by Romanian law, without prejudice to mandatory consumer protections in your country of residence. Disputes are subject to the competent courts of Romania. Contact us at contact@omniamus.com or OMNIAMUS S.R.L., Ploiești, Romania.
